These Terms of Use ("Terms") govern your use of the SkiMap mobile application and related services (the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
“SkiMap”, “we”, “us”, and “our” refer to The Stolen Spot S.R.L., incorporated in Bergamo, Italy.
1. Use of the App
1.1 The App provides general ski resort maps, terrain information, and related tools for convenience and informational purposes only.
1.2 Map data, resort boundaries, trail status, lifts, closures, and conditions may change at any time without notice. Parts of the App may be incomplete, inaccurate, or outdated.
1.3 You are solely responsible for your decisions on the mountain. You must follow all official resort maps, signage, ski patrol instructions, and local regulations.
1.4 The App is not a substitute for official resort information, professional guidance, or your own judgment.
2. Eligibility
2.1 You may use the App only if you are at least 13 years old or meet any higher minimum age required in your jurisdiction.
2.2 If you are under the age of majority, you confirm that you have permission from a parent or legal guardian.
3. Account and Onboarding
3.1 Certain features may require you to complete an onboarding flow or provide information such as preferences or skill level.
3.2 Temporary data collected during onboarding is processed as described in our Privacy Policy.
3.3 You agree that any information you provide is accurate and not misleading.
4. Subscriptions and Billing (SkiMap Pro)
4.1 Paid features are available through an auto-renewable subscription (“SkiMap Pro”).
4.2 Payment is charged to your Apple ID upon purchase confirmation.
4.3 Subscriptions renew automatically unless canceled at least 24 hours before the current period ends.
4.4 Your account may be charged for renewal within 24 hours before the period ends, at the price shown in the App Store.
4.5 You can manage or cancel your subscription in your Apple ID settings:
Settings → [your name] → Subscriptions.
4.6 Free trials or promotional offers convert to a paid subscription unless canceled at least 24 hours before the trial or offer ends.
4.7 If subscription pricing changes, required notices will be provided. Continued use after such changes indicates acceptance.
5. No Emergency or Safety Service
5.1 The App does not provide emergency services, rescue functionality, or real-time safety monitoring.
5.2 Do not rely on the App for avalanche alerts, weather warnings, or life-critical decisions.
6. No Professional Advice
6.1 Information in the App is for general informational purposes only and is not professional advice.
6.2 You must evaluate information independently before acting on it.
7. License and Acceptable Use
7.1 You are granted a limited, non exclusive, non transferable, revocable license to use the App for personal, non commercial purposes.
7.2 You may not:
Copy, modify, reverse engineer, decompile, or attempt to extract source code
Circumvent or interfere with security features
Use the App in an illegal, harmful, or abusive way
Use the App to build a competing service or scrape data at scale
7.3 Access may be suspended or terminated for violations of these Terms.
8. Map Data and Third-Party Services
8.1 The App uses third-party map providers and data sources. Their content is provided by the respective third parties.
8.2 We are not responsible for the availability, accuracy, or reliability of third-party data or services.
8.3 Your use of third-party services may be subject to their own terms and privacy policies.
9. Skiing Risks and Your Responsibility
9.1 Skiing, snowboarding, and mountain activities involve inherent risks including terrain hazards, weather, collisions, avalanches, and equipment failure.
9.2 By using the App, you acknowledge that:
You engage in mountain activities at your own risk
You are responsible for staying within resort boundaries
You must adapt your behavior to conditions, skills, and local rules
9.3 You assume all risks associated with skiing, navigation, and outdoor activities.
10. Disclaimer of Warranties
10.1 The App is provided “as is” and “as available” without warranties of any kind.
10.2 We do not guarantee that:
The App will be uninterrupted or error free
Map data or GPS information will be accurate or current
Defects will be corrected
10.3 All implied warranties are disclaimed to the fullest extent permitted by law.
11. Limitation of Liability
11.1 To the maximum extent permitted by law, The Stolen Spot S.R.L. and its owners, employees, and partners are not liable for:
Injuries, accidents, death, or damages resulting from skiing or use of the App
Indirect, incidental, special, consequential, or punitive damages
Loss of data, revenue, profits, or business
11.2 If liability cannot be fully excluded, our total liability will not exceed the greater of:
The amount you paid for SkiMap Pro in the previous 12 months, or
Ten (10) euros
12. Indemnity
12.1 You agree to indemnify and hold harmless The Stolen Spot S.R.L. from any claims, losses, damages, liabilities, or expenses arising from your use of the App or your violation of these Terms.
13. Privacy
13.1 Our Privacy Policy explains how we process personal data.
13.2 By using the App, you also agree to the Privacy Policy.
14. Changes to the App and Terms
14.1 Features may be added, altered, or removed at any time.
14.2 We may update these Terms periodically. The “Last updated” date will reflect changes.
14.3 Continued use after changes means acceptance.
15. Governing Law and Dispute Resolution
15.1 These Terms are governed by the laws of Italy.
15.2 Any dispute will be subject to the exclusive jurisdiction of the courts of Bergamo, Italy, unless mandatory consumer protections grant you additional rights.
